Hamilton JP, Speeding, 1 June 2015
Our client was accused of speeding. As he had 9 points on his driving licence, he had a lot resting on the outcome. The case was ostensibly about something as simple as the direction of travel as our client was adamant that – although he was stopped by the police – he was in fact driving in the opposite direction. The clear implication was that the police had confused his case with someone else’s (something that happens more often than you might think). There was also an issue regarding the speed limit for the road. The Crown was aware of this latter issue and tried to adjourn the trial. We successfully opposed this motion and the case was deserted simpliciter by the court, leaving a delighted and relieved client.
